By accessing or using the AgencyPartner.dev website (the “Site”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site.

The Site describes white-label development services for marketing agencies. Nothing on the Site constitutes an offer to contract. Project scope, deliverables, fees, and timelines are governed solely by a separate written agreement between you and us. Demo work shown in the portfolio is illustrative; it does not guarantee any particular outcome for your or your clients’ projects.
Disclaimer of warranties
THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Some jurisdictions do not allow certain warranty exclusions; in those jurisdictions, our warranties are limited to the fullest extent permitted by law.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AGENCYPARTNER DEV, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE AMOUNTS YOU PAID US (IF ANY) FOR SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM — SUBJECT TO THE PRECEDING SENTENCE, WHICH MAY NOT APPLY WHERE PROHIBITED BY LAW.
Consumers in the European Union, European Economic Area, United Kingdom, or Switzerland: Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under mandatory law. If you qualify as a consumer, you may have additional rights under the laws of your country of residence.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless AgencyPartner.dev and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any third-party rights.
